Data breaches at some of the well-known companies have become increasingly common in recent years, placing personal information of millions of consumers at risk. Hackers often aim to steal sensitive details such as names, addresses, Social Security numbers, and birth dates, which they later use for committing different kinds of fraud and identity theft. One such data breach incident has affected thousands of patients at McLaren Health Care Corporation in Michigan, and they may now be eligible for compensation through a class action settlement. Here's everything you might want to know.

MHCC, a well-known hospital chain, is facing accusations of not protecting sensitive patient details. Due to alleged negligence, massive data breaches reportedly occurred between July 28 and August 23, 2023, and again between July 17 and August 3, 2024. Such incidents in the healthcare sector are more concerning since they can expose highly sensitive information, like Social Security numbers, insurance details, and extensive medical histories. Patients are at risk of identity theft and fraudulent medical claims, according to Newsweek.

While MHCC has not admitted to any kind of wrongdoing, concerned authorities have agreed to pay $14 million to settle the allegations. A court granted preliminary approval to the settlement in December last year, allowing individuals whose information may have been exposed in the breaches to participate in the case. As per the reports, eligible individuals who file valid claims may now receive a one-time payment of up to $5,000. It's worth noting that people need not be Michigan residents to qualify for the settlement, as the data breach affected millions of individuals nationwide.

Kevin Thompson, the CEO of 9i Capital Group, spoke about the settlement and said, “These settlements often benefit the corporation by closing the case without liability. Those who can prove harm may receive compensation, but in many cases the payout is pennies on the dollar compared to the damage caused.” He added, “Victims of data breaches usually end up doing the hard work: monitoring credit, setting fraud alerts, and protecting their identity. The penalty rarely fits the crime, and once your personal data is exposed, the risks and potential costs can last for years.”

People who wish to receive compensation from the settlement must file a claim through the official website designated by the court. The exact amount each person receives is not fixed in advance and will be determined after the number of eligible claims filed is reviewed. In most such cases, participants receive modest compensation, ranging from a few dollars to several hundred dollars. Anything above this is usually reserved for individuals who can demonstrate documented financial harm directly linked to the breach, such as fraud losses or expenses resulting from identity theft.

A Note for the Company

Alex Beene, a finance expert, gave his view on the data breach incident and settlement, and said, “While McLaren denies any wrongdoing in the cyberattack, the agreement would also require the company to strengthen its cybersecurity practices moving forward.  As we've seen in recent years, handling the personal information of customers in any industry is becoming more difficult, and failure to do it properly can result in lawsuits worth significant money." He added, "It's a reminder to both companies and their customers of the risks involved and the need for more caution when inputting and maintaining personal data.”
